This is your Stack Sports International Instalment and Subscription Payment Agreement (Agreement) with SPay, Inc. d/b/a Stack Sports, a Delaware corporation located at 5360 Legacy Drive #150, Plano, TX 75024. This Agreement sets out your obligations in undertaking an instalment payment and/or automated subscription payment arrangement with us, and forms part of the terms and conditions of your direct debit request.
Stack Sports International Pty Ltd (ABN: 11 649 693 649) is a subsidiary company of SPay, Inc. d/b/a Stack Sports along with Stack Sports Australia Pty Limited (ABN: 76 608 341 260), Stack Sports NZ Limited (NZBN: 9429042499190) and Stack Sports UK Limited (CRN: 06809213).
Debiting your account
1.1 By written, verbal or online request you have authorised us (Spay Inc.) to arrange for funds to be debited from your provided payment method. The schedule for direct debits is listed on the registration form and confirmation email and we will process the debit of those funds from your provided payment method on the provided dates.
1.2 We will continue to rely on your authority to directly debit the amount of each instalment or subscription from your provided payment method until you advise us of any changes to the arrangements. We reserve the right to cancel the instalment plan and/or subscription payment schedule if one or more debits return a failure notification by your financial institution and to arrange with you an alternate payment method.
Cancellations and changes to your instalment and/or subscription agreement
2.1 We may change or vary any details of this Agreement or an instalment and/or subscription payment schedule at any time if such changes or variations do not have a detrimental impact on you.
2.2 We will provide you with at least fourteen (14) days notice for any changes which may have a detrimental impact on you.
2.3 For instalments, you will need to contact the organisation that provided the instalment to cancel your instalment plan agreement. Cancellations and any associated refunds are at the sole discretion of the organisation.
2.4 For limited subscriptions, you will need to contact the organisation that provided the subscription to cancel your subscription agreement. Cancellations and any associated refunds are at the sole discretion of the organisation.
2.5 For ongoing subscriptions, you may cancel your subscription agreement via the Member Profile portal.
Your obligations
3.1 It is your responsibility to ensure that there are sufficient clear funds available on your provided payment method to allow an instalment and/or subscription payment to be made.
3.2 If the payment fails for your provided payment method:
(a) We will process a re-try payment on that same provided payment method 24 hours later and notify you via email
(b) If the subsequent re-try payment fails 24 hours later, we will prompt you with an email to update your provided payment method and cease any subsequent payments to the failed payment method. The instalment and/or subscription plan will be paused.
(c) If/when a new and valid payment method has been updated, we will process the payment for any instalment and/or subscriptions that are past due. The instalment and/or subscription plan will resume.
Dispute
4.1 If you believe that there has been an error in debiting your provided payment method you should first contact the organisation who has set up this online registration form
4.2 Any queries you may have about an error made in processing a payment against your provided payment method should be directed to the organisation in the first instance so that they can attempt to resolve the matter. If they cannot resolve the matter, they can connect with Stack Sports International directly.
4.3 For any unresolved disputes after following the dispute resolution process outlined in this clause, you may lodge a claim through your financial institution.
